The SAVE Act: A Dangerous Deception Undermining American Democracy

The so-called Safeguard American Voter Eligibility (SAVE) Act is a wolf in sheep’s clothing. Marketed as a measure to protect election integrity, it is, in truth, an attack on our democracy—designed not to fix a real problem, but to create one. While its supporters claim it will prevent noncitizens from voting—a virtually nonexistent issue—this legislation is a ruthless attempt to silence millions of eligible American voters. The House version was passed on Thursday, April 10, 2025, next stop is the Senate.

A Manufactured Crisis

The SAVE Act is built on a myth: that noncitizens are voting in large numbers and skewing election outcomes. But multiple nonpartisan investigations, including those from the Brennan Center for Justice, have found no credible evidence of widespread noncitizen voting. This is a manufactured crisis—a political smokescreen designed to justify the bill’s draconian restrictions.

Instead of enhancing election security, the SAVE Act undermines it. It creates unnecessary hurdles for eligible voters, threatening to strip countless Americans of their most fundamental rights.

A Direct Attack on Vulnerable Communities

At its core, the SAVE Act weaponizes bureaucracy against those already marginalized. It targets individuals whose legal names do not match the names on their birth certificates—a common and entirely legitimate situation for millions of Americans.

Think about it:

• A married woman who changed her last name.

• A transgender or nonbinary person whose documents reflect their affirmed identity.

• An adoptee.

• A divorced person who kept a married name.

• A queer couple who chose a new family name.

• Someone whose name was entered incorrectly due to a clerical error.

More than 9 percent of citizens of voting age — or 21.3 million people — do not have documents readily available that prove their citizenship, per a study from VoteRiders, Public Wise, the Brennan Center for Justice and the Center for Democracy and Civic Engagement at the University of Maryland. All of them could be caught in a web of red tape, forced to provide an exhausting—and sometimes unattainable—collection of documents just to vote. This isn’t just voter suppression. It’s cruelty masquerading as “election security.”

For many, the cost of retrieving these documents—in time, money, or emotional labor—is a barrier that could effectively silence their voice at the ballot box.

Dismantling Voter Accessibility

The SAVE Act doesn’t stop at name mismatches. It aims to gut proven, accessible methods of voter registration like online systems, mail-in applications, and community registration drives.

These tools have expanded participation across the country, especially for rural voters, individuals with disabilities, and working-class Americans who can’t take time off to register in person. In 2020, they contributed to the highest voter turnout in over a century. Stripping them away is a deliberate step backward—and an unmistakable signal that certain voices are no longer welcome in our democracy.

A Partisan Power Grab

Let’s be honest: the groups most affected by this bill—women, LGBTQ+ individuals, communities of color, and low-income voters—tend to vote for Democrats. This legislation isn’t about election security. It’s a calculated move to suppress opposition, rig the rules, and shrink the electorate in favor of one party.

This tactic has a long history, but the SAVE Act is among the most egregious examples yet. Rather than earning support through policy or leadership, this bill aims to win by exclusion.

A Threat to Democracy and Public Health

Democracy is a public health issue. Our communities thrive when everyone has a voice in the policies that affect their lives—education, healthcare, housing, and safety. When you silence voters, you silence those most in need of support. You silence the parents trying to advocate for their children. You silence the trans youth struggling for recognition. You silence entire communities who have already been pushed to the margins.

The SAVE Act is not just a policy misstep. It’s a calculated strike against equity, inclusion, and justice.
